Terms of Service

These terms govern the use of NailDesk, point-of-sale software provided by Bao Le LLC (“we”, “our”, “us”). By using NailDesk you agree to them.

1. What we provide

NailDesk is software for running a nail salon: customer check-in, turn rotation, appointments, checkout, payroll and related text messaging. We provide it to the salon; the salon runs its own business with it.

2. Text messaging

NailDesk can send appointment messages and offers on a salon's behalf. The salon is the sender. Each salon registers its own sending number in its own name, and is responsible for the messages sent from it.

We provide the wording used to obtain consent, and every consent is recorded with the exact wording shown and the date. Salons must not send messages to anyone who has not agreed, and must honour a STOP request. Details are in our Privacy Policy.

Message frequency varies. Message and data rates may apply. Consent is never a condition of any purchase or service.

3. The salon's responsibilities

• Keeping its own account and PINs secure.
• The accuracy of prices, services, wages and tax settings it enters.
• Complying with the laws that apply to its business, including employment and consumer law.
• Keeping backups. NailDesk provides a backup feature; running it is the salon's responsibility.

4. Payments and card processing

Card payments are handled by the salon's own payment processor under a separate agreement. We do not hold funds and we do not store full card numbers.

5. Availability

NailDesk runs on the salon's own computer and continues to work without an internet connection. Features that need the internet — text messaging, card authorisation, online booking — depend on services we do not control.

6. Fees

Fees, including text message credits, are as agreed with the salon. Credits do not expire.

7. Your data

A salon's records belong to that salon. On request we will provide a copy in a usable format.

8. Ending the agreement

Either of us may end the agreement with reasonable notice. We may suspend access for non-payment or for use that breaks these terms or the law — including sending messages without consent.

9. Warranties and liability

NailDesk is provided as is. To the extent permitted by law we exclude implied warranties, and our total liability is limited to the fees paid in the twelve months before the claim. Nothing here excludes liability that cannot be excluded by law.

10. Changes

We may update these terms and will change the date above. Continued use after a change means acceptance.

11. Governing law

These terms are governed by the laws of the State of Florida.
